Chapters 16 -Street Obstructions and 26- Sidewalks of Title 12 of the Township Code of Ordinances entitled "Streets, Sidewalks and Public Places" contain information related to the clearing of roads and sidewalks during winter months.

Chapter 12.16 - STREET OBSTRUCTIONS

Sections:

12.16.010 - Obstruction of streets prohibited.

A. No person other than an employee or contractor of the township acting in his capacity as such shall, unless with prior authorization from the township, place, or cause to be placed, on the traveled surface, shoulder or right-of-way of the street or road accepted or maintained by the township, any wall, fence, structure, planting, stones, rocks, gravel, snow, ice, mud, dirt or other material in such manner that the same impedes the safe and unobstructed use of, and vehicular passage upon such street or road.

B. Existing walls, fences, structures, plantings, stones, rocks, or other materials within the right-of-way of any street or road accepted or maintained by the township shall not be reconstructed, repaired, enlarged or replaced unless prior authorization is granted by the township. In appropriate circumstances such authorization may be granted or deemed permitted pursuant to the provisions of Chapter 12.08, "Driveway Construction Standards," or Chapter 12.12, "Excavations," of this code.

12.16.020 - Responsibility of property owner.

It shall be the responsibility of each property owner to insure that snow plowed from their driveway is not placed on the traveled surface, shoulder, or any portion of the right-of-way so designated by the township, of any street or road accepted and maintained by the township.

12.16.030 - Violation—Penalty.

A. If walls, fences, structures, plantings, stones, rocks or other materials within the right-of-way of any street or road accepted or maintained by the township are dangerous to life or the public welfare (including, but not limited to, a danger to traffic on the street or road) the property owner or occupant of the property, on written notice from the township, shall remove the same. In case of emergency, the same shall be removed within twenty-four (24) hours (as designated in such notice); otherwise the same shall be removed within five days, or other longer time designated in such notice. If the same are not removed within the time specified in such notice, the township may remove, or cause to be removed, the same, and the cost of such removal shall be certified by the township superintendent of public works to the township committee. The township committee, on notice to the property owner and opportunity for hearing, shall examine the certificate, and if found to be correct, shall cause such cost to be charged against the property as a lien upon real property, to be added to and be a part of the taxes next to be levied and assessed thereon. Such cost, pursuant to N.J.S.A. 40:48-1.1 may also be collected, with interest, by action at law.

B. In addition, any owner or occupant of property having been given such notice to remove the same, who fails to do so within the time specified in such notice, shall be subject to a fine not exceeding one thousand dollars ($1,000.00), imprisonment for a term not exceeding ninety (90) days, or a period of community service not exceeding ninety (90) days, in the discretion of the municipal court judge.

12.16.040 - Enforcement.

The township zoning officer shall be the local enforcing official; except that the superintendent of public works shall have the responsibilities described elsewhere in this chapter.

Chapter 12.26 - SIDEWALKS

Sections:

12.26.010 - Snow and ice to be removed.

The owner and/or tenant of lands abutting or bordering upon sidewalks or walking areas of public streets and highways of the Township of Tewksbury shall remove all snow and ice from the sidewalks or walking areas for a minimum width of three (3) feet within twenty-four (24) hours after the same shall fall or be formed thereon.

12.26.020 - Placing snow in street forbidden.

Snow and ice so removed by the owner and/or tenant shall at no time be placed in the street abutting the sidewalks or walking area.

12.26.030 - Violations and penalties.

Any violation of this chapter shall, upon conviction, be punishable by a fine not exceeding one thousand dollars ($1,000.00), imprisonment for a term not exceeding ninety (90) days or a period of community service not exceeding ninety (90) days, or any combination thereof. Each day shall constitute a separate violation.
